New Commissioners for KPPU

After being decided by the Plenary Meeting of Parliament on December 11, 2012, the candidacies are officially announced as the Commissioner of Indonesian competition commission, KPPU, for the period of 2012 to 2017. It was later acknowledged by H.E. President Susilo Bambang Yudhoyono through a Decree No. 112/P Year 2012 dated on December 27, 2012. The new Commissioners are as follows:

  1. Mr. Muhammad Nawir Messi, M.Sc.;
  2. Prof. Dr. Ir. Tresna Priyana Soemardi, S.E., M.S.;
  3. Dr. Sukarmi, S.H., M.H.;
  4. Dr. Syarkawi Rauf, S.E., M.E.;
  5. Drs. Munrokhim Misanam, M.A., Ec., Ph.D.;
  6. Mrs. Saidah Sakwan, M.A.;
  7. Mrs. R. Kurnia Sya’ranie, S.H., M.H.;
  8. Dr. Drs. Chandra Setiawan, M.M.; and
  9. Mr. Kamser Lumbanradja, M.B.A.

Three of the Commissioners (No. 1-3) are the extended Commissioners from the previous period of 2006 to 2012. This has been the third period of KPPU having their Commissioners since their establishment in year 2000 through the Law No. 5/1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition.

Different from other Commissions or independent state bodies where the head is appointed together with the selection process at the Parliament and declared by the Presidential Decree, KPPU’s leadership is handed by Law to the Commissioners to select their own Chairperson and Vice Chairperson.

Nawir Messi, New Leader of Indonesian Competition Commission

Nawir Messi and Saidah Sakwan have been elected as the Chairperson and Vice Chairperson of the Indonesian Competition Commission (KPPU) for the periods of 2013 to 2015. They are the thirteenth Chairperson and Vice Chairperson of the Commission since its establishment in 2000. It is mandated by the Article 31 of the Law No. 5/1999 (competition law) that the Chairperson and Vice Chairperson of KPPU is selected amid and by the Commissioners.

The Commissioner Meeting (the highest decision making at the Commission) led by Commissioner Tresna P. Soemardi (the eldest) and Commissioner Syarkawi Rauf (the youngest), had elected Commissioner Nawir Messi by unanimous or by all Commissioners as the new leader of KPPU. Interestingly, different from other assignments, as the Commissioner Regulation No. 03/Per/KPPU/2013 regarding Procedure for the Appointment of Chairperson and Vice Chairperson of KPPU, the new Chairperson and Vice Chairperson will hold their office for  two and half year. It means that Commissioner Messi will hold the chair until July 15, 2015.

Commissioner Nawir was one of the extended Commissioners from the previous period (2006-2012), and was the Chairperson for year 2010-2011. Now, he is coupling with Commissioner Saidah Sakwan, former Member of Parliament (the Tenth Commission and the Sixth Commission), in leading KPPU to a brand new level of achievement. During her assignment as Member of Parliament, Commissioner Saidah was involved in the formulation of many Laws including the Investment Law, Small Medium Enterprises (SME) Law, and Special Economic Zone (SEZ) Law. She obtained her academic titles major in Sharia Law from IAIN Syarif Hidayatullah and Master of Sharia Law from UIN Syarif HIdayatulah Jakarta in 2003.

In his inauguration remark, Commissioner Nawir appreciated all kind spirit and solidarity of all Commissioners in embarking national mandate. “This is the trust of all Commissioners, and shows our sturdiness in mainstreaming competition into business behavior and national economic policy”, he said.

Under this appointment, the third period Commissioners is now having new leader that will commit to supervise the implementation of competition law in creating national economic efficiency for the people’s welfare. (FCD)
