Merger cooperation – Europe

The EU’s national competition authorities and the European Commission have agreed a set of best practices on merger review. The best practices aim to foster cooperation and information sharing for mergers that do not qualify for review by the Commission but require clearance in several Member States.

The Hungarian Competition Authority has initiated a public consultation on the draft of the Hungarian merger notification form and on the draft of the informal meetings related to the merger review.

Merger notification – Spain

The Spanish CNC recently published Guidelines on short-form notification of mergers, describing which type of concentrations are eligible for short-form notification to the CNC.

 
The U.S. antitrust agencies and the European Commission issued an updated set of “best practices” (and accompanying FAQs) that they use to coordinate their merger reviews.  The agencies also celebrated the 20th anniversary of the United States-European Union bilateral antitrust agreement.

The Competition Commission of India recently began reviewing mergers subject to notification requirements. The orders of the Commission on specific combinations are available online. Consultation with CCI prior to filing notice of a proposed combination is available.
